Beat Lease Agreement
To explain with more clarity our agreement for a beat license, first we have to define a few basic concepts:
A “Composition” in terms of our agreement refers to the beat itself (which can also be defined as an isolated musical work.)
The “Songwriter” is the producer who composed the beat.
The “Master Recording” is the original song you (the artist) bring to life when recording a vocal performance in synchronization with the beat (Composition). Then, this Master Recording becomes an isolated musical work in itself.
Leche Media grants to License a non-exclusive license to record vocal synchronization to the Composition, which would result in an original musical work (Master Recording.)
The “mechanical” right is the right to reproduce a musical work onto CDs, DVDs, records (digital and physical) or tapes.
In our agreement, we (Leche Media) warrant that we control the mechanical rights in and to the copyrighted beat (Composition). We grant to the Licensee (the artist) a non-exclusive license to use the Master Recording in the reproduction, duplication, manufacture, and worldwide distribution of phonograph records, cassette tapes, compact disk, digital downloads, and other miscellaneous audio and digital recordings, with the right to unlimited streams on digital streaming platforms and unlimited selling of the Master Recording in any physical form.
Performance rights are rights for a musical work to be performed publicly. Public performance occurs when a song is sung or played, recorded or live, on radio and television, as well as through other media such as the Internet, live concerts and programmed music services.
Leche Media grants the artist (Licensee) a non-exclusive license to use the Master Recording in unlimited performances, shows, or concerts.
Synchronization rights refer to when the reproduction of a musical work is made onto a soundtrack of a film, video game or TV show.
Leche Media grants unlimited synchronization rights for music videos streamed online (Youtube, Vimeo, etc..) with no limit on the number of streams for any platform. A separate synchronization license will need to be purchased for distribution of the Master Recording of music video to Television, Film or Video Game.
Leche Media grants the Licensee a non-exclusive license to broadcast or air the Master Recording in unlimited station and radio station channels.
The Licensee shall acknowledge the original authorship of the Composition (the instrumental beat) appropriately and reasonably in all media and performance formats (under the name "Leche Media" or that of the Songwriter) in writing where possible and vocally otherwise.
The Licensee owns 100% of publishing rights for the Master Recording.
The period of time in which the agreement for a non-exclusive beat lease is valid is of 2 years. The lawful use of the Composition is limited to this time frame. After 2 years of contract, a new agreement must be negotiated.
The beat will be delivered via email to the email address that the Licensee provides to us. We will send an email containing an attachment or link from which the artist can download the Composition.
